Attached is the reply from the CoJ Dept of Development Planning and Urban Management. Marian Laserson attended the hearing on behalf of OGRA. We object to the removal of restrictions that relate to the sale of liquor ie: Condition (a) in all title deeds in Orange Grove. You will see that the Condition (a) had been retained and the council is taking note of the OGRA policy. Many restrictive conditions in our title deeds are outdated EXCEPT condition (a). To date we have won all Town Planning Hearings relating to the ROR(Removal of Restrictions). We have several more Town Planning Hearings 888-889 OG win for OGRAcoming up and in all cases there is a suspicion that if the removal of condition (a) is approved then a shebeen will be your new neighbour.

I refer to the article in this week’s NE Trib that refers to a property we have been trying to get action on since 2009. We have a large body of correspondence about this property.
Attached are the ownership details from Windeed and these are “public domain”. We have had sight of the CoJ accounts arrears on both properties ,erf 529 and erf 528 Orange Grove total R1,014,650.00 to date.
There are three possible scenarios (1, if there is no outstanding bond owing to ABSA on the properties then ABSA is out of the picture. (2, ( regardless) the onus is now on the CoJ to take responsible action to claim the arrears and institute legal action. (3, if both the bond and rates are in arrears then ABSA and CoJ are culpable .
OGRA never stated that the owner was dead, we stated that she (not he) was untraceable through our channels. Mr. Mafunzwaini of ABSA claims that the owner is alive and has been informed of her duties. Indeed there has been a cursory cleanup ( by a resident, not owner) as per the Environmental Health letter of 22, August 2012. The attached .jpg is of a faeces & fly infested part of the property. Rats scurried for cover as we entered the gate.
I challenge the owner Dolores Rokos, Mr. Mafunzwaini of ABSA and Environmental Health to meet OGRA and the Ward Committee on site to see for themselves the disgusting conditions that prevail. The surrounding property owners are enduring inhuman, unsanitary and dangerous conditions .Is it not time that the CoJ Revenue Dept collected?
The report by Mandisa Zulu, attached, I dispute. I believe that resolution of this is the single most important issue we have.
It is obvious that the photos were taken by Mandisa to illustrate a point of view< however if the passage pic is enlarged one can clearly see the jerry-built sewage out-pipe as in my pic. Mandisa cleverly avoids the pile of rubbish next to the wall with Dumisani. The rest of the mess by the double story as I have illustrated has been ignored< . Where the arrears figure of R80,000.00 comes from I have no idea. The documents in my possession clearly state the correct arrears amounts.

There is room for discussion on the issue.
- When is an accommodation establishment a commune? and vice versa.
- What are the bylaws on both?
- Does Orange Grove need Communes or Accommodation Establishments ?
- Does the Commune Policy extend beyond tertiary education areas?
- What has OGRA discussed with landlords?
- What has OGRA discussed with Development Planning?
- OGRA will interface and advise any owner prepared to go the legal route.
- Conversely we will work to close down the bad & ugly.
These are some of the questions I hope to answer over the next few weeks
ORANGE GROVE does need decent,well run, well maintained accommodation . BUT not overcrowded health hazards. We will highlight the good, bad & ugly.

Being sparse with the truth appears to be a requirement to have a “place of public worship” Maybe the management( term used loosely ) has been schooled in obfuscation as a requirement to obtain the godly diploma that confers the right to hoodwink the populace and Council AND the POLICE of all persuasions < What is it that so emasculates JMPD and SAPS when they are called to deal with “religious issues” ?? Do they think that some divinity will strike them blind or dead if they dare to enforce noise bylaws.Not that that matters>>since the divinity invasion along Louis Botha Ave appears to have struck the fear of some obscure Nigerian deity into the hearts of our enforcers. They are powerless in the face of these demigods. Electronic Jesus blasters rule our suburbs, saints direct traffic and fill takeout parking lots with the hundreds of milling worshipers . And the residents suffer without the succor of absolution. What will Christmas bring to Louis Botha Ave?? To 9th street, 10th Street, to 11th street and all points of the compass> is any deity all-powerful??? but>> merciless to our residents who only want peace & quiet.
The Good News is that Winners lost their application for the “relaxation of Parking” so it is illegal to use the Doll House parking lot for their congregants BUT since there is no enforcement the whole issue becomes a lot of hot air> coming up is the court case >The Council interdict is being challenged by Winners. Much to be expected. May Winners be the losers and may residents resume their constitutional right to live in peace & quiet and enjoy the amenity of their residential investment in our suburb.
